Definitions

1. Definitions of terms used in these Regulations:
   1. Website – www.gretix.com website owned by Gretix Sp. z o.o. used for Providing Services
   2. Service – provision of services to Users, free of charge or for consideration.
   3. User – shall mean every person using the Website in any way.
   4. Reminder – shall mean a service of reminding about any events defined by the User in the Website.
   5. SMS Reminder – shall mean receipt of a Reminder in the form of SMS text message.

General provisions

1. These Regulations lay down general rules comprising legal grounds for using the Gretix Website, obliging its Users to comply therewith. Detailed Regulations referring to specific services provided electronically by Gretix or other entities, pursuant to contracts concluded with Gretix, shall be made available by Gretix or a given entity providing particular services, on websites enabling the use of such services. Each User shall obey provisions of these Regulations, the moment he undertakes actions aimed at using the Website.
2. The Website is managed by the Company under the name of Gretix Sp. z o.o., with its registered office in Warsaw, Al. Jerozolimskie 146 C, entered into the National Court Register – Business Register kept by the District Court, XII Economic Division, under KRS entry no. 0000251923 (hereinafter: "Gretix").
3. Each person using the Website (hereinafter: the “User”) gives their absolute consent to the content of the Regulations. The Website can be used by persons having a registered personal account on the Website and by persons using the Website without having a personal account.
4. These Regulations constitute a legally binding agreement between the User and the owner of the Website regarding the use of the Website by the User. The User shall carefully read the Regulations.

Provision of Services

1. Gretix Website is a website for personal use.
2. Provision of services by Gretix may be suspended, especially when Gretix has sufficient reasons to believe that security measures were broken, the Website is used for purposes other than those for which it was designed, as well as in the case of any breach of provisions hereof.

Obligations of Gretix

1. As part of the provided services, Gretix shall:
   1. Inform Website Users about any changes related with these Regulations,
   2. Remind Users about their obligations in due time, during their use of the Website,
   3. Respect and comply with all provisions related to privacy protection policy and personal data protection,
   4. Provide full functionality of the Website with respect to Reminders,
   5. Ensure relevant procedures aimed at providing proper security of IT systems and databases used by the Website,
   6. Provide all necessary information about these Regulations, services provided by the Website and User accounts.

Obligations of Users

1. As part of using the Website, the User shall:
   1. Be liable for disseminating information about services among all persons indicated by the User and for all events resulting therefrom,
   2. Carefully read these Regulations,
   3. Declare that they are adults or that they are using the Website upon the consent of their parents or legal guardians,
   4. Use the Website in good faith in compliance with its intended purpose,
   5. Disable the use of User personal accounts by any third parties,
   6. Use the Website only for their own use.

Responsibility for using the Website

1. Gretix reserves the right to decide about Website content, introduced changes and modifications on its own, without the need to warn Users about its intentions. The User assures that they will use the Website, as regards receipt and transmission of information, only in a manner compliant with legal regulations in force, principles of social existence and best practice, in consideration of intellectual property rights.
2. Gretix would like to warn you that the Website is used exclusively at the cost and risk of the User, and that it shall not guarantee that this use will be undisturbed by any errors, faults or breaks and that functionality of the Website will meet User’s expectations as regards content, accuracy or usefulness of the obtained information, unless such guarantee was expressly formulated in any Gretix document.
3. Gretix shall not be liable for any effects of using information obtained by the User by means of the Website, especially for consequences of decisions made on its basis with regard to managing one’s finances, healthcare, children upbringing and education, leisure activities and any other aspects of leading an active life.
4. Gretix shall not be liable when the Website will be used, contributing to:
   1. Gaining unauthorized access to other computers in the network, access to transmitted data, other materials sent or received, or access to operations conducted on the Website.
   2. Publishing illegal, obscene, offensive content, where Gretix reserves the right to remove such content from the Website.
5. Gretix shall not be liable, if the content presented on the Website may constitute an affront to religious feelings of any third parties or in any other way violate constitutional rights of an individual.
6. Any attempts of illegal access to or use of the Website in the manner contrary to the Regulations, will result in resorting to legal remedies by Gretix or competent authorities.
7. Gretix shall not be liable, if:
   1. the Website fails to meet Users’ requirements,
   2. Inappropriate use of the Website resulted in damage attributable to the User,
   3. The Website is not working properly due to events Gretix could not foresee or prevent while acting with utmost care, especially in case of problems with Website operation related to the quality of services provided directly by IAP (Internet access provider), GSM network operators and due to force majeure events.
   4. The User was using the Website contrary to the provisions hereof,
   5. There occur effects of third parties coming into possession of a password enabling Website access,
   6. Breaks in the provision of services resulted for technical reasons (e.g. maintenance, review, replacement of equipment) or reasons beyond Gretix control,
   7. There occurred data loss caused by equipment or system failure or any other
8. In the case when as a result of using the Website by the User, any entities or third parties shall raise any claims against the Website owner, the user shall be fully and exclusively liable, and especially he shall cover all eventual compensation and any documented costs in respect thereof.

Responsibility for using the Website

1. In order to use the Services properly, the following requirements should be met:
   1. Connection to the Internet,
   2. Microsoft Internet Explorer 5.0 or higher, or compatible browser,
   3. In case of some websites, in order to fully use their functionality, it may be necessary to run the SSL (Secure Sockets Layer) protocol in your browser, Java Script, Java and cookies services.
2. Users are forbidden to provide illegal content (especially comments to messages).

Intellectual property rights

1. Gretix shall ensure that the Website contains copyright-protected documents, trademarks and other materials, especially text, photos, graphics, audio and video materials, and that selection and arrangement of the content presented on the Website is itself the subject matter of legal and copyright protection.
2. Among documents made available by means of the Website, there are documents protected by copyright granted to Gretix, affixed with proper labelling as well as documents whose copyright is owned by other entities, what follows especially from relevant copyright notes placed thereon, disseminated on the Internet by Gretix pursuant to legal regulations in force and contracts, including license agreements.
3. Website Users shall use any content presented thereon only for their own personal use. Copying, modification, transmission, public performance and any use of this content for commercial purposes, requires prior written consent of Gretix or any other authorized entity.
4. Users shall ensure that any use of copyright-protected materials by means of the Website to the benefit of any third parties, including their copying, transmission and publication on the Internet is performed upon the consent of authorized entities. Users shall be liable for any damage caused by their behaviour contrary to the above provision.
5. By providing the materials by means of the Website, the Users consent to their exploitation by other Users for their personal use, and Gretix reserves the right to editing, copying and dissemination of these materials.

Confidentiality Policy

1. Gretix shall ensure Users’ privacy and personal data protection.
2. Hereby, Gretix would like to warn Users that in the event of using some types of Services offered by the Website, they will be asked to give some specific personal data which will be collected and used by Gretix.
3. By accepting these Regulations, the User confirms that he has carefully read and accepted all rules specified in the Privacy Policy.

Registering User account

1. Natural persons being Website Users shall declare that they are adults or that they are using the Website upon the consent of their parents or legal guardians.
2. "Data" shall mean all data provided to Gretix during registration of a User or while using the Website, as well as data contained in electronic mail sent to Gretix or communicated by telephone. The User shall be fully responsible for Data content.
3. The User declares that Data he provided:
   1. Shall not be false, inaccurate or misleading,
   2. Shall not violate any third party rights, including trademarks, trade secret or personal interest,
   3. Shall not violate the laws in force,
   4. Shall not be offensive and will not contain punishable threats addressed to any third parties,
   5. Shall not contain viruses or other computer programs designed to cause damage, capture data or make computer systems incapable to use,
4. The User shall update his Data.
5. Users personal data will be processed for purposes related with the acquisition of access to the Website and its use by Gretix as an administrator of this data set.
6. The User may consent to the processing of their personal data for marketing and statistical purposes of Gretix.
7. Gretix informs that giving consent to the processing of personal data for marketing and statistical purposes is voluntary and it does not comprise a condition for using Services offered by the Website.
8. Moreover, Gretix declares that the User has the right to access their personal data and make any adjustments thereof.
9. Gretix shall provide the User with access to current information about an entity to whom it will entrust processing of data, information about their scope and intended date of transmission.
10. If updated data provided by the User shall prove false, inaccurate or misleading, Gretix has the right to suspend or delete User account on the Website and refuse current and future provision of Services.
11. After completion of the registration process, the User shall gain access to the full functionality of the Website as regards defining and management of Reminders.
12. By using the Website, the User consents to transmission of their personal data by Gretix to entities cooperating therewith for marketing purposes, in keeping with requirements specified in the Act on Personal Data Protection of August 29, 1997.

SMS Reminder

1. SMS Reminder services are offered to all Website Users having a mobile enabling sending and receiving Reminders in the form of SMS text messages.
2. SMS Reminder service is ordered by sending SMS with a verification code to SMS Premium number provided on the Website. For sending a text message under SMS Reminder, the User is charged according to prices provided on the Website.
3. The use of SMS Reminders is done according to the following rules:
   1. The User makes use of SMS Reminder by sending an order for Reminders in the form of text messages to a given SMS Premium number.
   2. Contents of a text message ordering Reminders, as well as the proper SMS Premium number are indicated on the Website.
   3. In response to SMS Premium comprising the order, the User receives SMS text message with information confirming the receipt of a specified number of Reminders.
4. Gretix shall not be responsible for any failure to deliver SMS in the case when the User is out of range of the network or his mobile is not active within 6 (six) hours from the time of sending the order.
5. Gretix shall not be liable for costs incurred by the User as a result of sending SMS at variance with these Regulations or with information published on relevant pages of the Website.
6. Gretix shall not be responsible for incorrect entering of the order code or choosing incorrect SMS Premium number by the User.
7. By purchasing the Reminder service, the User consents to receiving information about other services offered by Gretix as well as information about promotions, competitions and other commercial activities conducted by Gretix. This consent especially refers to information received in the form of SMS.
8. If within 24 (twenty-four) hours from the moment of ordering SMS Reminder, the User will not receive a confirming SMS text message, he is entitled to lodge a complaint at: help@gretix.com.
9. After the first order failure, the User shall not place any more orders. In the case of failure to comply with the principle referred to in the preceding sentence, Gretix shall not be liable for a multiple failure in ordering the product.
10. Using SMS Reminder service is tantamount to acceptance of these Regulations.

Complaint procedure

1. Complaints against services provided by Gretix may be lodged in writing (registered letter) at: Gretix Sp. z o.o., Al. Jerozolimskie 146 C, 02-305 Warszawa. Each complaint should clearly indicate the person lodging the complaint (first name, surname, correspondence address, phone number, e-mail address) and description of the event constituting grounds thereof.
2. All complaints shall be processed within 21 (twenty-one) days from the date of receiving by Gretix a correctly filled in complaint form.

Complaint procedure

1. The program is aimed at rewarding Users purchasing Goods in the Gretix On-line Shop or using selected Website functions.
2. A User who will purchase any Goods labelled with credit points or who will use a credit-awarded Website function will be enrolled to the Program automatically.
3. In return of purchasing credit-awarded Goods or using appropriate Website functions, a User receives credit points exchangeable into prizes or services offered in the credit system working within the Website.
4. Credit value of individual Goods will be displayed next to the image or description of the Goods. Information about credit value of each Website function will be displayed in a relevant section of the Website.
5. Current number of credit points will be recorded on a User account in the Website database.
6. In case of return of the ordered Goods, credit account will be reduced by the number of credit points equal to credit value of those Goods.
7. Each User participating in the Program will have access to information about the amount of confirmed credit points on the credit account on the Website.
8. Amount of credit points granted to the User will be determined on the basis of records in the Website database and displayed on a purchase document of Goods or selected Website functions, data updated by purchases of Goods or selected Website functions.
9. In case of resigning from purchasing the Goods or selected Website functions, the User shall lose all collected credit points.
10. Credit points confirmed in the Order form will be exchanged to prizes indicated in Website regulations, according to their credit value. Identical rule will apply to the use of Website functions.
11. Only credit points confirmed on the User account will be exchangeable, granted for the purchase of Goods or selected Website functions made before the fixed date of summing up the points in the database.
12. Confirmed credit points may be exchanged to prizes after receipt of notification about the first confirmed amount of points.
13. Selected prize will be delivered together with the Ordered Goods or in a separate parcel. In case of temporary prize sell-out, the prize will be delivered with a subsequent Order or at the time it will be available again.
14. Courier receipt will serve as a confirmation of accepting the prize by the User.
15. On sending the prize, number of points equal to credit value of the prize will be subtracted from the User account.
16. Credit points cannot be exchanged to cash.
17. Credit points cannot be transferred to another User.
18. It is forbidden to add up points from a number of Users.
19. Complaints about Goods – prizes (in case of possible faults) will be handled according to complaint procedure regarding sale of gifts under these Regulations.
20. Return of Goods shall reduce the number of credit points by the credit value displayed on this product.
21. Gretix reserves the right to change the inventory of prizes. The prize will be delivered to the User as soon as possible.
22. Gretix reserves the right to modify, suspend or close the program at any time without stating a reason. Amendments to the regulations as well as modification, suspension or closing the Program cannot violate rights acquired by Users. Information about modifying, suspending or closing the Program will be published on pages of the Website.
23. In case of modifying, suspending or closing the Program, credit points granted until that date may be used within 1 (one) month from the date of modifying, suspending or closing the Program. Upon the lapse of the aforementioned period, they cannot be used and they will be cancelled.

Final provisions

1. Gretix shall not bear any liability, especially third party, penal and administrative liability for the use of Website by the User in the manner contrary to provisions of these Regulations.
2. The Regulations may be amended by Gretix at any time, by publishing the amendments on this page of the Website. Any amendments to the Regulations become effective the moment they are published on this Website, unless stipulated otherwise.
3. All queries related to Website functioning should be sent by the User by e-mail at: info@gretix.com.
4. All disputes arising from the content hereof will be settled by the court proper for the registered office of Gretix.
5. All issues and disputes connected with operation of the Website shall be governed by the Polish law.
6. Relevant provisions of the Polish Law shall apply to all issues which are not governed hereunder.
